1. Acceptance of Terms

By accessing or using the PeopleIQ SA website at peopleiqsa.co.za and the PeopleIQ SA platform at app.peopleiqsa.co.za (collectively, the "Services"), you agree to be bound by these Terms of Use. If you do not agree, please discontinue use immediately.

These Terms apply to all visitors, registered users, and subscribers of PeopleIQ SA (Pty) Ltd ("PeopleIQ SA", "we", "us").

2. Website Use

The PeopleIQ SA website is provided for general information and marketing purposes. You may browse the website freely. You agree not to:

• Use automated tools to scrape, crawl or copy content without permission
• Attempt to gain unauthorised access to any system or server
• Transmit any malicious code, malware or harmful content
• Use the website in any manner that may damage our reputation

3. Platform Use

Access to the PeopleIQ SA platform requires a valid subscription. By subscribing you agree to:

• Maintain the confidentiality of your login credentials
• Ensure only authorised personnel access your organisation's workspace
• Use the platform solely for lawful HR and workforce management purposes
• Comply with all applicable South African labour law, POPIA, and employment equity legislation
• Not share access credentials with competitors or third parties

4. Intellectual Property

All content, code, design, trademarks, logos, and intellectual property on the PeopleIQ SA website and platform are owned by PeopleIQ SA (Pty) Ltd or its licensors. You may not:

• Copy, reproduce or distribute our content without written permission
• Reverse-engineer, decompile or disassemble the platform
• Use our brand name, logo or trademarks without permission

Your organisation retains ownership of all HR data and employee information you upload to the platform.

5. Prohibited Use

You may not use PeopleIQ SA to:

• Violate any applicable law or regulation, including the Labour Relations Act, Basic Conditions of Employment Act, or POPIA
• Discriminate unlawfully against employees on any protected ground
• Store or process illegal content
• Harass, threaten or defraud any person
• Attempt to circumvent any security or access control
• Resell or sublicence access to the platform

6. AI Recommendations Disclaimer

PeopleIQ SA provides AI-generated insights, recommendations, scoring and analysis as decision-support tools. These outputs are advisory only and are intended to assist qualified HR professionals and business leaders not to replace human judgement.

No AI-generated output from PeopleIQ SA constitutes a final HR decision. Decisions concerning hiring, promotion, remuneration, disciplinary action, retrenchment, or any other action affecting an employee must be made by an appropriately qualified and authorised human decision-maker within your organisation, in compliance with applicable South African labour law.

PeopleIQ SA accepts no liability for HR decisions made on the basis of AI-generated outputs.

7. Payment Terms

• Subscription fees are billed monthly in South African Rand (ZAR), exclusive of VAT
• Payment is processed securely by Paystack (Pty) Ltd
• Subscriptions renew automatically unless cancelled before the renewal date
• Refunds are considered on a case-by-case basis contact support@peopleiqsa.co.za
• PeopleIQ SA reserves the right to suspend access for non-payment

8. Limitation of Liability

To the maximum extent permitted by South African law, PeopleIQ SA, its directors, employees and agents shall not be liable for:

• Any indirect, incidental, special or consequential loss or damage
• Loss of data, profit, revenue or business opportunity
• Any HR decision made using AI-generated insights from the platform
• Interruption or unavailability of the platform

Our total aggregate liability to you shall not exceed the total fees paid by you in the three (3) months preceding the claim.

9. Availability

We aim to maintain high platform availability but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where possible. We are not liable for downtime caused by third-party infrastructure or force majeure events.

10. Governing Law

These Terms of Use are governed by the laws of the Republic of South Africa. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the South African courts.

11. Changes to These Terms

We may revise these Terms from time to time. Continued use of the Services after notification of changes constitutes acceptance of the updated Terms.
